How Workers’ Comp Attorneys Are Paid: Exploring Fees and Costs Involved in a Work Injury Case

Attorneys who handle workers’ compensation cases work on a contingency basis, meaning they only receive payment after they have secured benefits for their clients. If there is no recovery there is no fee. The fee structure for California workers’ comp lawyers typically is 15% fee of the total permanent disability award (which is considerably lower than the 33% to 40% charged by personal injury lawyers in Superior Court cases).
